Shortwave: Another List of Blocked Sites and Another Revival of Mobile Market Analysis – Lupa.cz

On August 17, 2022, the Czech Communications Authority (ČTÚ) released another draft version of the wholesale mobile market analysis, officially topping the number of issues of the 5G auction terms, which also at one point saw several muddled rewrites.

Let us remind you that the Counter-Terrorism Unit held a previous consultation on the draft regulations for the mobile market from May 27 to June 27, 2022, and took the comments in the consultation only as a framework, because, as he himself stated, “I received some basic comments, which required a more thorough evaluation and calculations, and it was necessary to comment on them in the analysis or to complete the relevant chapters”. At the same time, ČTÚ conducted an analysis of the final decision of the European Commission on the issue of mobile phone sharing in the Czech Republic and voluntarily accepted the commitments.

The scope of the proposed regulation remains the same, both in terms of the number of regulated entities (all three mobile operators) and in terms of corrective measures (including wholesale price regulation, wholesale prices will be set on the principle of no margin pressure).

A relatively large part of the new proposal is devoted to ČTÚ analysis to justify why the national roaming obligations of O2 in the so-called 5G auction did not increase the level of effective economic competition in the Czech mobile market. ČTÚ believes that according to the information provided to it by the relevant authorities (and after their own assessment), “Market entry will not be implemented using the national roaming obligation imposed before 2025.”. The regulator says frankly, who – which “There is no certainty or reasonable degree of probability that a new national operator will enter the retail and wholesale markets based on the use of the national roaming commitment or commercial national roaming within the time horizon of the market analysis.”.

In Chapter 3.1.10 of the Analysis Project, ČTÚ states that “To provide national roaming using the spectrum groups distributed in the Czech Republic, an investment in the visiting operator’s network may be necessary (must?) and not yet achieved. Specifically, it is an investment in “core” network infrastructure systems to provide 5G type SA (type “Stand Alone”). This may not have been known before…

And even if that happened, he wouldn’t win. An important aspect that affects the end customer satisfaction of national roaming recipients and operating costs is the extent and density of population coverage through its own network. If the network coverage of the national roaming recipient is heterogeneous, the end devices may adversely affect the quality of services from the end customer’s point of view through frequent switching between networks. The condition is not suitable.

In another paragraph, ČTÚ says that “According to his information, coverage of all realistic potential beneficiaries of national roaming (oh, there are also unrealistic potential beneficiaries of national roaming? And may I know who they are?) is far from consistent and homogeneous, especially for internal coverage in the 3400-frequency band – 3600MHz”. What a surprise. And cherry: “If the end device of the customer receiving national roaming is in national roaming, it periodically checks for the presence of its own network (so-called background scans”). Thanks to a total of three operators. The auction brought another player in the mobile market – Centronet – to The smaller companies that exist: PODA and Nordic Telecom. All these small operators now have the opportunity to be a real competitor in the mobile market.”

This means that the new operators will be able to offer their spectrum to the existing big three. And some shy offers are said to be already falling back on the market.

So who is the winner in the end? Definitely outside consulting firms. More blocking sites

Another list of blocked websites has been taken care of by MPs. With the parliamentary amendment, we have another office that can issue a block list for websites. On August 16, 2022, the President signed into law August 10, 2022 amending Law No. 242/2000 Coll. , regarding organic agriculture and amending Law No. 368/1992 Coll. , regarding administrative fees, as amended, as amended, and Law No. 146/2002 on State Examination of Agriculture and Food and amending some relevant laws and its amendments. This bill was enriched with amendments in the House of Representatives during the meeting of the Agriculture Committee, which included the competence to create and maintain another list of blocked sites.

The State Inspectorate of Agriculture and Food now maintains and publishes a list of websites that offer dangerous foods or those whose content seriously violates the requirements established by the legal regulations for which the inspection is responsible (“list of sites”) and publishes it on its website and decides on the registration of sites in the list of sites and their deletion from the list of sites.

In contrast to the competence of the Ministry of Finance, the above-mentioned power is given to the Inspectorate, and the appellate body is the Central Inspectorate for Inspection (Article 3c). Participants in the actions are the operator or owner of the domain name of the website, which is subject to the registration procedure for the list of websites. If it is not possible to identify a participant in the actions, then he will be identified in the actions in the actions as the operator or owner of the domain name of the website, the subject of the registration procedure for the list of sites, and the address of this site. In these cases, the Inspectorate does not appoint a trustee in the proceedings.
